Terms and Conditions ("These Terms")

Eligibility
The Quest is open to all individuals worldwide including outsiders and internal staff except those who are on the evaluation and judginge panels. However, internal staff participants should only work on and submit their product ideas or concepts during non-office hours.

All information submitted must be in English.

How to submit your ideas

2.1

Click on the "Submit your idea" at home page

2.2

Fill in the submission form and submit your product ideas according to the examples and guideline in the form.

2.3

You may upload any supplementary information such as sketches, additional descriptions, etc, but ONLY in MS Word, Excel, Powerpoint, JPEG and PDF format not large than 1M size.

2.4

You may be required to submit personal information such as your full name, address, email address, contact telephone number and so forth. The terms of use of such personal information are contained in our Privacy Policy.

Judging criteria

Oregon Scientific will evaluate all submitted products ideas and concepts periodically under the following criteria:
. Originality and innovation,
. Sufficiency of information (such as, without limitation, "how it works" and "how to make it work"),
. Benefits and applications,
. Technical feasibility in product development;
. Manufacturing risks, and
. Appeal to consumers in terms of perceived value, aesthetics, and smart living concepts

Oregon Scientific reserves the right to make the final selection of the product ideas. Please note that it is possible that someone may have submitted a similar idea before you did. In such case, we will select the earlier submitted idea.

Oregon Scientific will not return submitted ideas and concepts to you. Likewise, in view of the foreseeable number of product ideas or concepts that we may receive and the complicated evaluation process, Oregon Scientific will not provide progress updates. However, we will contact you if your submitted idea or concept is selected. Otherwise, Oregon Scientific makes a reasonable non-obligatory attempt to notify you once a final decision has been made.

Suggestion Box 

We appreciate that many product ideas or concepts potentially form the backbone of true innovation, but before such product ideas or concepts are reduced to practice or described in a reasonable level of tangible detail, they cannot be properly categorized as innovation and such ideas or concepts will unlikely be eligible for participation in the Quest.

However, we treasure your product ideas and concepts and, in order to keep such ideas and concepts "alive", we have established a "Suggestion Box" to gather those ideas and concepts that, although not eligible for the Quest for now, may help improve our products and your user experience in the future.

Prior to submission of your product ideas and concepts under the Quest, you will be asked if you would allow us to transfer your ideas and concepts into our Suggestion Box should it not qualify under the Quest by not meeting our judging criteria. You must select either "Yes" or "No" before your product idea and concept will be successfully submitted.

If you select "Yes" and your submitted product idea or concept does not qualify under the Quest, you agree to the following:

. that your submitted product ideas and concepts will be transferred to Oregon Scientific's Suggestion Box;
. that you unconditionally allow Oregon Scientific and/or its affiliates to freely use your product ideas and concepts for product/service improvement purposes, including without limitation any incorporation of such product ideas and concepts into future products/services whether in its original, modified or derived form;
. that you unconditionally allow Oregon Scientific to publish such ideas and/or concepts in any way as it deems fit and proper;
. that you will not be rewarded in any way as a result of Oregon Scientific or its affiliates' use of such product ideas or concepts;
. that you will waive all your rights (if any) in such product ideas and concepts, including any intellectual property rights that may arise by virtue of such product ideas and concepts; and
. that Oregon Scientific and its affiliates will not be liable to you in any way by virtue of any use or modification of your product ideas and concepts.

If you select "No" and your submitted product idea or concept does not qualify under the Quest, Oregon Scientific will make reasonable efforts to permanently erase all data relating to such product idea or concept from its system and records.

The Reward Scheme
There are three levels of rewards:

4.1

Entry prize of US$ 150 or local currency equivalent if
. Your product idea or concept has been evaluated and selected by the judge panel for feasibility study and development

4.2

Grand prize of US$1,000 or local currency equivalent if
. Your product idea or concept has been commercialized for mass production and market launch

4.3

Discretionary bonus of up to US$2000 or local currency equivalent if
. Within 12 months from product launch date, the total net sales revenue meets or exceeds Oregon Scientific's prescribed sales target(s).

Winner notification
Oregon Scientific will notify the winners by email. All winners must acknowledge receipt of the notification and confirm to us the payee name and the bank account within 14 days following such email. If a winner fails to reply to the acknowledgement within this period, Oregon Scientific reserves the right to forfeit the reward.

Intellectual Property

6.1

By submitting the idea, you agree and warrant that, to the best of your knowledge and belief, you are the sole creator/author of, and have the legal right to submit to us, the submitted idea or concept, that the idea or concept is original, and that it is neither subject to or violates any intellectual property rights owned by others. Oregon Scientific and its associated companies (Oregon Scientific) will not be liable for any damage or loss incurred by the submitted ideas or from the participation of the quest in submitting the idea

6.2

Oregon Scientific and/or its associated companies will become the owner of all intellectual property rights, if any, subsisting in all selected ideas and concepts.

6.3

Ideas, in and of themselves, are generally not accorded legal protection. Certain steps must usually be taken to obtain trademark, copyright or patent protection of an idea or concept, if such protection is available. By submitting an idea or concept, you understand that the idea or concept may or may not have legally protected rights and are submitted at your own risk.

6.4

Oregon Scientific's consideration of any submitted idea or concept or any subsequent selection thereof does not waive its right to Quest the validity of any patents, copyrights, trademarks, or other intellectual property rights related to, or covering, the submitted idea or concept.

6.5

By entering this Quest, you agree that Oregon Scientific may use his/ her/their name(s), address(es), comments, likeness(es), photos, and a description of the submitted idea or concept, if the individual accepts any prize, in publicity and/or advertising concerning this Quest or otherwise in any medium now known or hereafter devised (including the Internet or other interactive network) in perpetuity throughout the universe without further compensation or right of review and agrees to waive his/her rights with respect to such publicity and/or advertising. You warrant that such information, idea or concept description, etc., will not be defamatory, offensive, abusive or of an obscene or menacing character, will not contain information about persons who have not consented to the use of such information, will not offend against reasonable standards of taste and decency and will not infringe any third party intellectual property rights.

Other Terms

7.1

Your submission of an idea or concept automatically confirms your acceptance of These Terms. You agree that decisions of Oregon Scientific are final and binding upon all entrants for all aspects of the Quest. Non-compliance with any of These Terms will be grounds for disqualification of the selected submission, forfeiture of any prize and the selection of an alternate submission to win the forfeited prize.

7.2

Oregon Scientific must disclose a submitted idea or concept to its employees, and possibly others, in order to determine the idea or concept's value to us. Accordingly, no confidential relationship is created, absent a written agreement to the contrary, based on Oregon Scientific's receipt and consideration of an idea or concept.

7.3

Oregon Scientific employs innovative people and receives ideas and concepts from outside sources. So it is possible that Oregon Scientific is already practicing, or has practiced, an idea or concept identical or similar to that which you submitted. Similarly, it is possible that Oregon Scientific has already conceived of an identical or similar idea or concept. Finally, it is possible that Oregon Scientific has already received an identical or similar Idea from an outside source. Consideration of your submitted idea or concept does not surrender Oregon Scientific's right to practice its own or others' ideas or concepts.

7.4

Oregon Scientific: (i) makes no warranty, guarantee, or representation of any kind concerning any prize, (ii) disclaims any implied warranties, and (iii) shall not be liable for injury, loss or damage of any kind resulting from the acceptance of any prize or from participation in this Quest.

7.5

Oregon Scientific shall not be responsible for lost, stolen, illegible, incomplete, delayed, or misdirected submissions, or for technical hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, or damaged online entries or garbled or delayed computer transmissions, which may limit your ability to participate in the Quest in any way. Oregon Scientific shall not be responsible for any problems or the technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, failure of any email on account of technical problems or traffic congestion, or any combination thereof, including any injury or damage to your or any other party's computer or other property related to or resulting from your participation in or downloading any materials in connection with this Quest.

7.6

Oregon Scientific reserves the right to cancel the Quest at any time, without notice and for any reason, including, but not limited to, reasons of fraud, technical failures, virus, bugs, unauthorized human intervention, or other causes destroying the integrity of the Quest as determined in Oregon Scientific's sole discretion and to award the prizes based on entries received prior to such cancellation. Oregon Scientific shall not be liable for any interruption to this Quest whether due to Force Majeure or other factors beyond its reasonable control.

7.7

Oregon Scientific reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary these Termswithout prior notice, provided that any such variations do not apply to submissions made prior to the effective date of the varied Terms. The effective date of these Terms and any variation thereof is stated at the beginning of these Terms.

7.8

You agree to comply with all export laws, rules and regulations applicable to the submitted idea or concept and/or the submission thereof in this Quest.

7.9

This Quest is governed by Hong Kong laws and subject to the exclusive jurisdiction of the Hong Kong Courts.
